Terms of Use — Curitiba Biennial App

1. Acceptance of terms

By downloading, installing or using the Curitiba Biennial app, developed by Outvision XR, you confirm that you have read and agree to these Terms of Use. If you do not agree with any provision set out here, please do not use the app.

2. About the app

The app delivers Augmented Reality (AR) experiences integrated with the artworks of the Curitiba Biennial exhibition. It is free to use and requires no registration, login or account creation. Some features depend on access to the device's camera and location, as described in the Privacy Policy.

3. Licence to use

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for personal, non-commercial purposes. This licence does not transfer any ownership rights over the app or its content.

4. User conduct

You agree not to copy, modify, decompile, reverse engineer, distribute, resell or create derivative works from the app or its content. You also may not use the app for unlawful purposes, nor attempt to interfere with its operation, security or availability.

5. Intellectual property

The app, its interface, code, trademarks and visual elements belong to Outvision XR. The artworks, images, videos and other content displayed in Augmented Reality belong to their respective artists, curators and rights holders, and are displayed under authorisation. No content may be reproduced, recorded or published for commercial purposes without the prior written consent of the rights holders.

6. Safety while using the app

Augmented Reality experiences require you to point your device's camera at the physical environment. Stay aware of your surroundings while using the app, follow the venue's signage and staff instructions, and do not use the app while walking in hazardous areas, on stairs, on public roads or in crowded spaces. You are responsible for your own safety and for your device during use.

7. Availability and changes to the service

The app is provided on an "as is" basis. AR experiences are tied to the period and venue of the exhibition and may be modified, suspended or discontinued at any time without prior notice. Performance also depends on external factors such as device model, operating system version, GPS signal quality and ambient lighting conditions.

8. Limitation of liability

To the fullest extent permitted by applicable law, Outvision XR shall not be liable for indirect, incidental or consequential damages arising from the use of or inability to use the app, including technical failures, unavailability of AR experiences, data loss or damage to the device. This limitation does not affect consumer rights guaranteed under Brazilian law.

9. Privacy

Data handling within the app is governed by the Curitiba Biennial App Privacy Policy, which forms part of these Terms of Use. We recommend reading that document carefully before using the app.

10. Changes to these terms

These Terms of Use may be updated periodically to reflect app improvements or legal changes. The date of the last update will always be indicated at the top of this page. Continued use of the app after any changes constitutes acceptance of the current version.

11. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of Curitiba, state of Paraná, shall have jurisdiction over any disputes, without prejudice to the consumer's right to bring proceedings in their own place of domicile.
